This Privacy Policy explains how we collect, use, process, store, and safeguard information across our services, websites, IoT platforms, and Ellenex-branded products (collectively, the “Services”). This policy is intended primarily for business customers and authorized users of our AI services and industrial IoT solutions.

1. Information We Collect

We collect information necessary to provide, maintain, and improve our Services, including:

Contact Information: Name, professional email address, mobile or business phone number, company affiliation, and account credentials.

Device & Technical Data: IP addresses, unique device identifiers (IMEI, serial numbers), firmware versions, configuration settings, and system logs.

Performance & Telemetry Data: Sensor readings, threshold triggers, predictive analytics inputs, and system health metrics.

Sensitive Information: Precise geolocation data (where enabled by device hardware) and authentication credentials.

Automated Data: Cookies, session identifiers, tracking technologies, and analytics data used to improve functionality and performance.

2. Legal Basis for Processing

We process personal information based on contractual necessity, legitimate business interests, user consent where applicable, and compliance with legal obligations.

3. Role of LPWAN (Controller and Processor)

In most cases, LPWAN acts as a data processor on behalf of enterprise customers, who act as data controllers and determine the purposes and means of processing data collected through deployed devices. Customers are responsible for ensuring compliance with applicable data protection laws.

4. Mobile Numbers and SMS Communications

Mobile numbers are used exclusively for operational and security purposes, including device-triggered alerts, threshold warnings, anomaly notifications, multi-factor authentication, and critical account communications.

We do not sell, rent, lease, or share mobile numbers or SMS opt-in data for marketing or promotional purposes. Users may opt out of SMS alerts at any time by replying STOP or adjusting preferences within the device portal.

5. How We Use Personal Information

We use personal information to:
- Deliver and maintain our Services
- Configure and support IoT devices
- Provide technical support
- Send service and security notifications
- Improve product performance and system reliability
- Ensure system integrity and prevent fraud
- Comply with legal and regulatory requirements

6. Data Sharing and Service Providers

We do not sell personal information or generated data by devices to data brokers or third-party advertisers.

We may share data with trusted service providers (such as cloud hosting providers, SMS delivery platforms, analytics vendors, and security partners) who are contractually required to safeguard data and use it solely for authorized service delivery purposes.

We may also disclose information when required by law, to enforce contractual rights, or to protect system security.

In the event of a merger, acquisition, restructuring, or sale of assets, personal information may be transferred as part of that transaction, subject to appropriate safeguards.

7. Cookies and Automated Technologies

Our website and platform may use cookies and similar technologies to operate essential services, analyze traffic, improve functionality, and enhance user experience. Users may manage cookie preferences through browser settings or our cookie management tools.

8. Data Retention

We retain personal information only for as long as necessary to fulfill contractual obligations, provide Services, comply with legal requirements, resolve disputes, and enforce agreements. Retention periods vary depending on the nature of the data and applicable regulations.

9. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect personal information, including industry-standard encryption for data in transit and at rest, role-based access controls, secure cloud infrastructure, and ongoing monitoring.

In the event of a security breach affecting personal information, we will notify affected parties in accordance with applicable state and federal laws.

10. International Data Transfers

Personal information may be processed and stored in the United States or other jurisdictions where our service providers operate. Where required by law, we implement appropriate safeguards for cross-border transfers.

- Opt out of the sale or sharing of personal information
- Limit the use of sensitive personal information

To exercise these rights, contact us using the information provided below.

12. Artificial Intelligence and Automated Processing

Our Services may incorporate artificial intelligence (AI), machine learning, and predictive analytics features (“AI Services”). AI-generated outputs are provided for informational and operational support purposes only and may contain inaccuracies, omissions, or unintended results.

LPWAN Holding Inc does not guarantee the accuracy, completeness, or reliability of AI-generated outputs. Users are solely responsible for reviewing and validating outputs before making operational, business, regulatory, or safety decisions.

AI Services may rely on enterprise-grade third-party providers. Customer data is not used to train public AI models unless explicitly authorized in writing. Aggregated and anonymized data may be used to improve system performance and analytics.

While we implement commercially reasonable safeguards, no AI or automated system can be guaranteed to be error-free or completely secure.

13. Children’s Privacy

Our Services are intended for business use and are not directed to individuals under the age of 16. We do not knowingly collect personal information from minors.
